Welcome to Lemon & Herbs. By accessing our website and purchasing our products, you agree to being bound by the following terms and conditions.

1. Scope and Governing Law

This agreement is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Thai courts.

2. Product Warranty & Consumer Rights

• Natural Variation: Please acknowledge that our products are living plants. Each plant is unique and may naturally vary in size, shape, number of leaves, and appearance from the photos shown on our website.
• Damage on Arrival (Defective Goods): We warrant that our plants are healthy upon dispatch. If your plant arrives damaged or dead, you have the right to claim a replacement or refund. Please report it to us with clear photos within 24 hours of delivery.
• Limitation: We are not responsible for damage caused by your own mishandling or neglect after safe delivery.
• Unfair Contract Disclaimer: Nothing in these terms is intended to exclude or limit our liability for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under the Thai Unfair Contract Terms Act B.E. 2540 (1997).

3. Product Ranking & Authenticity

Products on our website are generally sorted by "Newest" or "Staff Picks" to highlight seasonal availability and recommendations. We do not accept payments to artificially boost the ranking of specific products without disclosure, in compliance with consumer protection standards regarding accurate information.

4. Orders, Pricing, and Payment

• Currency: All prices are listed in Thai Baht (THB) and exclude VAT unless otherwise stated.
• Order Acceptance: We reserve the right to cancel or refuse any order (e.g., for pricing errors or out-of-stock items). If we cancel an order you have already incurred a charge for, we will issue a full refund.
• Cash on Delivery (COD): If you choose COD, we comply with OCPB regulations, including the "Dee-Delivery" measures where applicable, ensuring your right to inspect goods before final acceptance where required by law.

5. Shipping and Risk of Loss

• Delivery Area: We currently ship products only to addresses within Thailand.
• Risk Transfer: The risk of loss or damage to the products passes to you upon delivery to your specified address. However, we remain responsible for ensuring the carrier delivers the goods safely to that point.

6. Intellectual Property

All content on this website, including but not limited to text, images, logos, and graphics, is the exclusive property of Lemon & Herbs and is protected by Thai intellectual property laws.

7. Cancellation and Refund Policy (Consumer Protection)

• Defective Products: You are entitled to a full refund or replacement for products that are defective or not as described.
• Change of Mind: Due to the perishable nature of live plants, we generally do not accept returns for "change of mind" unless the product has not yet been dispatched.
• Cancellation: You may cancel your order before it has been shipped for a full refund.
